Ltd hereinafter referred to as “SPORTYLIFE ”. This Site is operated by SPORTYLIFE and materials on the Site as well as applications are primarily owned by SPORTYLIFE.

SPORTYLIFE is always committed to value your trust and adheres to standards in managing and safeguarding user information. The Site may also include materials owned by third parties and posted on the Site by virtue of a license, grant or some other form of agreement between the third party and SPORTYLIFE. SPORTYLIFE has created this Site for your fitness, health, nutrition and education. However, you are only authorized to access this Site and contents hereof or to use the materials contained in the Site (regardless of whether your access or use is intended) if you agree to abide by all applicable laws, and to these Terms of Use and Privacy Policy, which constitute an Agreement between you and SPORTYLIFE. Your use of the Website, Application, or services in connection with the Application, Website or products (‘Services’), or registrations with us through any modes or usage of any products including through SD cards, tablets or other storage/transmitting device shall signify your acceptance of this Policy and your agreement to be legally bound by the same. If you do not agree with the terms of this Policy, do not use the Website, Application our products or avail of any of our Services.

PERSONAL AND SENSITIVE INFORMATION

The said information collected from the users could be categorized as Personal Information, Sensitive Personal Information and Associated Information. Personal Information, Sensitive Personal Information and Associated Information (each as individually defined under this Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the ‘Data Protection Rules’)) shall collectively be referred to as ‘Information’ in this Policy.

The Information may be used to contact you from time to time, to provide you with the Services, important information, required notices and marketing promotions. You may be asked to contact us and provide more information that personally identifies you.

Your password is your first line of defence once you set up a SPORTYLIFE account; we recommend that you set a strong password, which you never share with anyone. It will not be differentiated between who is using the device to access the Application or Website, so long as the login access credentials match with the user. In order to make the best use of the Application/Website ensure to have logged in using your own credentials.

We implement industry-standard technical and organizational measures by using a variety of security technologies and procedures to help protect your data from unauthorized access, use, loss, destruction or disclosure.

The collection, storage, usage, and sharing of your data by the Company shall be in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable laws.

All payment transactions are made through a third-party payment gateway that does not retain, share, store or use personally identifiable information for any other purpose.

Individual data may be used to understand the behaviour patterns combined with personal information to provide you with personalized content, and better learning objectives. No information is sold; we do not trade or rent to any third party unless it is authorised either in writing or electronically to do so. Aggregate statistics may be provided to our customers, traffic patterns, and related site information to reputable third parties, however, this information when disclosed will be in an aggregate form and does not contain any of your Personally Identifiable Information.

SportyLife will occasionally send email notices or contact you to communicate about our services, products and benefits, as they are considered an essential part of the services/products you have chosen.

As required by law, such as to comply with a subpoena or similar legal process; to enforce applicable Terms of Use, including investigation of potential violations thereof; disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request; with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Policy; to protect against imminent harm to the rights, property or safety of the Application or its users or the public as required or permitted by law; with third-party service providers in order to personalize the Application for a better user experience and to perform behavioural analysis; any portion of the Information containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor’s legal guardian. Such consent is deemed to be provided by your registration with us.

If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Applications/Services/Websites/products. SPORTYLIFE is concerned about safeguarding the confidentiality of your Information. Physical, electronic, and procedural safeguards are provided to protect the Information we process and maintain. For example, we limit access to this Information to authorized employees only who need to know that information in order to operate, develop or improve our Application or Website. Please be aware that, although we endeavour to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

RETAINING USER DATA:

Currently, we plan to retain user data while an account is active and for at least two years afterwards. We may alter this practice according to legal and business requirements. For example, we may lengthen the retention period for some data if needed to comply with law or voluntary codes of conduct. Unless otherwise prohibited, we may shorten the retention period for some types of data if needed to free up storage space.

15 User-generated information in the form of water and calorie intake and the ‘My Diary’ feature.

16 Calendar events including the information from the user’s calendar events, event notes and attendees.

17 Other actions include any other information generated by the user through likes, comments, shares and invite options.

We automatically collect purchase or content use history {the users must provide accurate information so the Ideal Body Weight can be advised correctly}.

4.4 The full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time); products and/or content you viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information.

4.5 By using this Application, you are agreeing that We may advertise your feedback on the Website and marketing materials.

4.6 We will retain the information as long as we require this to provide the user with the goods and services and for such a period as mandated by the concerned laws.

10. APPS THAT TARGET CHILDREN

10.4 Additionally, Apps may be provided with or installed via the Services, as noted elsewhere in this policy, to provide the SPORTYLIFE. The Apps may collect, process, and store personal information locally and/or transmit that information to cloud infrastructure. The application includes device information, sensors, and software interfaces that the Apps may use to collect personal information from you or your child. The Apps are governed by separate privacy policies and terms of use, which must be consented to by you prior to their use.

    10.4.2 At any time, you may review your child’s personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us to further collect or use the child’s information.

SPORTYLIFE may request personal information about your child from your child, parents, guardians, and/or teachers. We collect only the minimum amount of information needed about students from teachers, and any such information is used only in connection with the Educational Institution’s use of the SPORTYLIFE Learning Experience.

If you are under 18 years of age, then please do not use or access the Services at any time or in any manner unless we have received verifiable parental consent from your parent or guardian.

Users when unhealthy or feeling weak should not attend live or recorded workout sessions

One should keep in mind his/her limitation in physical strength while working out or pushing hard. We shall not be held responsible for any injuries at any point in time.

Users should clearly mention their likes, dislikes, allergies, food patterns, cuisines, diet patterns, and medical complications to our expert nutritionists. We shall not be held responsible for any negative consequences.
