a. This Website with the URL — www.Sportylife.in

("Website/Site") is operated by  — Mission Sports Private Limited

In order to purchase any of the Services online, you must register for an account with us via the Application of Android or IOS.  If you already have an account with us you can log into your account using your username and password.

 

Note: All personal pronouns mentioned anywhere on SportyLife’s website, WebApp or any material hereinafter are made gender-neutral to signify any person irrespective of gender. The terms ‘men’ and ‘women’ mentioned anywhere in the content and material owned by SportyLife are inclusive of all transgenders and non-binary persons who may or may not identify themselves with either of the nouns or pronouns. 

 

1. GENERAL  

 

  1. We at SportyLife are committed to protecting and respecting your privacy. We do collect your personal information (as defined under the Information Technology Rules of 2011) and process your personal data in accordance with the IT Act, 2000 (21 of 2000) and other national and state laws which relate to the processing of personal data. Please read the following carefully to understand our views and practices regarding your personal data. 
  2. We collect your personal information in order to provide and continually improve our products and services.
  3. Our privacy policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this policy periodically.
  4. All partner firms and any third-party working with or for Us, and who have access to personal information, will be expected to read and comply with this policy. No third party may access or process sensitive personal information held by Us without having first entered into a confidentiality agreement. 

 

2. HOW WE COLLECT THE INFORMATION

 

  1. All personal, sensitive and associated information shall be collectively referred to as ‘Information’ in this policy. The SportyLife website, as well as the application, may collect such information automatically including, by not limited to, the type of mobile device you use, the IP address of your mobile device, the device’s unique device ID and your type of mobile operating systems. 
  2. At the time you register with us for our service, we shall require camera and microphone access while you avail products/ services/subscriptions. 
  3. From you directly and through this Site: We may collect information through the Website when you visit. The data we collect depends on the context of your interactions with our website.
  4. Through business interaction: We may collect information through business interaction with you.
  5. From other sources: We may receive information from other sources, such as public databases, joint marketing partners, social media platforms or other third parties such as:

 

1. Updated delivery and address information from our carriers or other third parties, which we use to correct our records and deliver your next purchase or communication more easily.

2. Information about your interactions with the products and services offered by our subsidiaries.

 

3. INFORMATION WE COLLECT

 

a. We collect information primarily to provide better services to all of our subscribers. 

b. When you visit our Site, some information is automatically collected. This may include information such as the Operating Systems (OS) running on your device, Internet Protocol (IP) address, access times, browser type, and language, and the website you visited before our Site. 

c. Personal information and SPDI (where necessary) are collected for the provision of the Services on the Mobile App/web app, including your nutrition data, dietary and lifestyle information, information related to height, weight and body measurements,  physical activity, photographs, biometric information, genetic information, information, race and ethnicity-related information, family-related information (to the extent necessary for effective provision of Services), sleep habits and other sleep activity, or health-related information and insights for our Services and Products. We automatically collect purchase or content use history, which we sometimes aggregate with Best Seller, Top Rated, etc.. {kindly provide accurate information so the Ideal Body Weight can be advised correctly}

d. The full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time); cookie number; products and/or content you viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs).

e. We automatically collect information using "Cookies". Cookies are small data files stored on your hard drive. Among other things, cookies help us improve our Site, our marketing activities, and your experience. We use cookies to see which areas and features are popular and to count visits to our Site.

a. Information about our users is an important part of our business and we take due care to protect the same.

b. We share your data with your consent or to complete any transaction or provide any product or service you have requested or authorised. We also share data with our affiliates and subsidiaries, with vendors working on our behalf.

c. We may employ other companies and individuals to perform functions on our behalf. The functions include fulfilling orders for products or services, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting

content, scoring credit risk, and providing customer service.

d. These third-party service providers have access to personal information needed to perform their functions but may not use it for other purposes. Further, they must process the personal information in accordance with this Privacy Policy and as permitted by applicable data protection laws.

a. We take due care to protect customer data. Technical measures are in place to prevent and against accidental loss or destruction of, or damage to data. The employees who are dealing with the data have been trained to protect the data from any illegal or unauthorised usage.

b. We work to protect the security of your information during transmission by using Secure Sockets Locker (SSL) software, which encrypts information you input. SSL allows sensitive information such as credit card numbers, UID and login credentials to be transmitted securely. 

c. We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling branded credit cards from the major card schemes.

d. We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information.

e. We take reasonable steps to help protect your personal information in an effort to prevent loss, misuse, and unauthorised access, disclosure, alteration and destruction. It is your responsibility to protect your usernames and passwords to help prevent anyone from accessing or abusing your accounts and services. You should not use or reuse the same passwords you use with other accounts as your password for our services.

f. It is important for you to protect against unauthorised access to your password and your computers, devices, and applications. Be sure to sign off when you finish using a shared computer.

g. Information you provide to us is shared on our secure servers. We have implemented appropriate physical, technical and organisational measures designed to secure your information against accidental loss and unauthorised access, use, alteration or disclosure. In addition, we limit access to personal data to those employees, agents, contractors, and other third parties that have a legitimate business need for such access.

h. Information collected from you will be stored for such period as required to complete the transaction entered into with you or such period as mandated under the applicable laws. 


 

7. LINKS TO THIRD PARTY SITE/APPS

Our Site may, from time to time, contain links to and from other websites of third parties. Please note that if you follow a link to any of these websites, such websites will apply different terms to the collection and privacy of your personal data and we do not accept any responsibility or liability for these policies. When you leave our Site, we encourage you to read the privacy policy of every website you visit.

 

8. SOCIAL NETWORK PLUGINS

This Website incorporates plugins and/or buttons for social networks, in order to allow easy sharing on your favourite social networks. These plugins are programmed so as not to set any cookies when assessing the page to safeguard the privacy of users. Cookies may be set, if you make voluntary use of the plugin. The collection and use of information obtained by means of the plugin are governed by the respective privacy policies of the social networks.


 

9. SHARING OF PERSONAL INFORMATION

a. We do not share your personal data with third parties without your prior consent other than:

1. With third parties who work on our behalf provided such third parties adhere to the data protection principles set out in the IT Act, 2000 (21 of 2000) and other applicable legislation, or enter into a written agreement with Us requiring that the third party provide at least the same level of privacy protection as is required by such principles;

II. To comply with laws or to respond to lawful requests and legal processes;

III. To protect the rights and property of Us, our agents, customers, and others including enforcing our agreements, policies and terms of use;

IV. In an emergency, including to protect the personal safety of any person.

V. For the purpose of a business deal (or negotiation of a business deal) involving the sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture or bankruptcy transaction or proceeding).

 

10. CHANGES TO THIS POLICY

We hold complete discretion over amending, changing, modifying, adding or removing including the right to suspend, cancel and discontinue our terms of service, the software, products and services on offer, pricings for the product offered without notice. Similarly, modifications and alterations can also be made without the requirement of prior notification to suit our interests as and when deem fit. If we make any changes to this policy, we will change the "Last Updated" date above. You agree that your continued use of our services after such changes have been published to our services will constitute your acceptance of the such revised policy.

If you have any concerns about privacy or grievances with Us, please contact us with a thorough description and we will try to resolve the issue for you.

 

11. Refund Policy

This being that there will be no refund or Pro-Rata cancellations of the subscription.

a)Fitness Services / Digital Services ( LMS) – Any memberships/sessions/classes bought by You are non-refundable, non-exchangeable, non-saleable or Non-transferable.

 

With regards to payments, the Platform shall not be responsible for any unauthorised transactions conducted on our Platform using Your payment card or internet banking etc. The Platform shall not be obligated to refund any money to You in such instances.  

 

12. Online Course The Online Courses are for training purposes only. Sportylife will not accept any responsibility to any party for the use of the Online Course or Course Materials for any purpose other than training for educational purposes, including but not limited to, the giving of advice by you to any third party. 

Liability for Injury: Sportylife shall not be liable for any loss, injury, death, or damage to persons or property which at any time may be suffered or sustained by any person who may at any time be using or visiting the Application/web app and Onground Training or be in, on or about the same whether such loss, injury, death or damage shall be caused by or in any way result from or arise out or any act, omission or negligence of Application/ web app and On-Ground Training or shall result from or be caused by any other matter of thing whether of the same kind as or of a different kind than the matters of things above set forth, shall indemnify Owner against all claims, liability, loss or damage whatsoever on account of any such loss, injury, death or damage.

 

The Subscriber shall not (and shall procure that its representatives shall not) access, store, distribute or transmit any Viruses, or any material during the course of its use of the Publisher Services that:

*is unlawful, harmful, threatening, defamatory, obscene, infringing, *harassing or racially or ethnically offensive;

*facilitates illegal activity

*depicts sexually explicit images;

*promotes unlawful violence;

*is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; or in a manner that is otherwise illegal or causes damage or injury to any person or property.

*The Publisher reserves the right, without liability or prejudice to its other rights to the Subscriber, to disable the Subscriber’s access to any material that breaches the provisions of this clause.

*All information including content, material, trademarks, trade secrets, service marks but not limited to software, text, images, graphics, script and audio and other such information on the site contained in the website and application of SportyLife.in are the proprietary property of the company and no such information may be copied, downloaded, reproduced, modified, republished, posted, uploaded distributed and transmitted by any other third party without the permission of the company. 

*The customers are prohibited from using any of the products, website application and service for any purpose other than personal purposes. In other words, the customer cannot usde the company’s website for commercial purposes. 


 

13. About The Learning Management System In order to ensure a smooth transition for a child to learn perfectly we will be unlocking only 5 sessions in 60 days.

On-ground training will be provided to schools only, if the school allows the same and sports facilities are available. We cannot be held responsible for a sport that is selected and the school lacks the necessary infrastructure. 

 

On-ground training can only be conducted inside school premises under the supervision of PT Masters and Sports Coaches under the school's management.

Free onsite training for trainers will begin 30 days after the MOU is signed. The sports curriculum for Physical Trainers is licensed based on the infrastructure.

There will be no coaches or equipment provided by us for sports

 

14. Live-streamed webinars are often delivered via the internet at a time and date agreed upon by the parties

1.2 In the Agreement (except where the context otherwise requires):

1.2.1 Whenever the legislation or Applicable Law is referred to, it includes (a) all subordinate legislation that has been made under it from time to time and (b) all legislation superseding legislation that formerly implemented any Indian legislation notwithstanding the fact that such new legislation may no longer implement Indian legislation..

A  reference to the singular includes a reference to the plural and vice versa; When referring to one gender, the other genders shall be included unless otherwise indicated.

As part of the Agreement, the schedules are incorporated;

1.2.5 Reference to any clause or schedule is to a clause or schedule (as the case may be) of or to the Agreement; and

1.2.6 It is understood that the terms "including", "include", "excluding", "exclude", "in particular", or similar terms in this Agreement shall be construed as illustrative only and shall not limit the sense of those words preceding and shall not limit, respectively, the generality of any description preceding such term.

1.3 Headings are for convenience only and shall not affect the interpretation of these Standard Terms.

1.4 The terms defined in the Term Sheet shall have the meanings set forth in the Term Sheet.

 

1.5 The Agreement shall be binding upon and inure to the benefit of the Parties and their respective personal representatives, successors and permitted assigns, and references to a Party shall include that Party's personal representatives, successors and permitted assigns.

 

15 APPLICATIONS OF THESE STANDARD DATES

 

2.1 These Terms and Conditions and the terms set out in the Term Sheet are the only terms and conditions upon which the Publisher is willing to negotiate with the Customer, and they shall govern the Contract to the entire exclusion of all other terms and conditions.

 

2.2 No terms and conditions (other than these General Terms and Conditions and those set out in the Term Sheet) contained in or supplied with any other document (whether or not the such document is referred to in the Contract) or any other terms and conditions which the Customer may wish to impose or incorporate shall not form part of the Contract.

 

2.3 The Publisher recommends that the Customer print a copy of these General Terms and Conditions to have them at hand for future reference.

 

 16. NOTICES

 

“Any notice required or permitted to be governed hereunder shall be given in writing”

 

Note: In the event of inaccessibility of the SportyLife App from the App Store(IOS)and Play Store (Android), the Party shall be able to access the online curriculum through the SportyLife Web App.
